1. ACCEPTANCE OF TERMS

For electronic beauty devices and instruments (micro-needling, EMS, laser, cupping, etc.): These devices operate at frequencies or intensities that may cause discomfort, temporary skin irritation, or injury if misused. Users must follow all safety instructions. Persons with pacemakers, metal implants, or active skin infections must not use electronic devices. Pregnant individuals must not use certain devices without medical approval.

The Company assumes no liability for outcomes from proper or improper use, allergic reactions, skin sensitivities, injuries, or any adverse health effects arising from or related to product use, whether foreseeable or not.

4. PURCHASING AND PAYMENT

4.1 Order Acceptance
Placing an order does not constitute acceptance by the Company. The Company reserves the right to review, reject, cancel, or modify any order for any reason, including but not limited to: fraud detection, risk assessment, inventory discrepancies, pricing errors, or violations of these Terms. You will be notified of cancellation via email. Orders are deemed accepted when the Company issues an order confirmation email and processes payment. Acceptance occurs in Wyoming, United States.

4.2 Pricing and Availability
All prices are displayed in United States Dollars (USD) and are subject to change without notice. Prices do not include applicable sales taxes, VAT, or import duties, which are the responsibility of the purchaser. If you reside in a jurisdiction with sales tax or VAT obligations, you are responsible for calculating and paying those amounts. Product availability is not guaranteed. If an item is out of stock or becomes unavailable, the Company will contact you, and payment will be refunded in full without additional compensation.

4.3 Payment Methods and Security
We accept payment via Stripe, PayPal, and other payment processors integrated on our website. All payment processing is handled by third-party payment providers, and your payment information is subject to their terms, privacy policies, and security standards. The Company does not store full credit card numbers or sensitive payment data on our servers. By submitting payment, you authorize the payment processor and the Company to charge the amount shown on your order. The Company is not liable for unauthorized charges, payment processor failures, or security breaches by third-party payment providers.

4.4 Billing Errors and Disputes
If you believe you have been charged incorrectly or fraudulently, you must notify the Company in writing within 30 days of the charge. Include your order number, transaction date, and reason for the dispute. Disputes filed after 30 days may not be processed. The Company will investigate and respond within 15 business days. If the charge is determined to be in error, we will credit your account. If the charge is correct, no adjustment will be made. For payment disputes, you may also contact your payment processor or credit card issuer directly. The Company will cooperate with any formal dispute investigation. Chargebacks: If you initiate a chargeback with your payment processor without first contacting the Company, we reserve the right to suspend your account and refuse future orders. Repeated chargebacks may result in permanent account closure and referral to collection agencies or law enforcement as permitted by law.

5. SHIPPING AND DELIVERY

5.1 Shipping Methods and Timeframes
The Company offers multiple shipping options at varying speeds and costs, displayed at checkout. Standard shipping typically takes 7-14 business days domestically and 14-30 business days internationally. Expedited and priority options are available at additional cost. Shipping timeframes are estimates and are not guaranteed. Delays may occur due to carrier issues, weather, customs processing, address errors, or other factors beyond the Company's control. The Company is not liable for late deliveries or for costs incurred due to delays. Orders placed before 12:00 PM EST Monday-Friday will typically ship the same business day. Orders placed outside these hours or on weekends/holidays will ship on the next business day.

5.2 Shipping Costs
Shipping costs are calculated based on package weight, destination country/region, and selected shipping method. All shipping costs are non-refundable. International customers are responsible for all import duties, tariffs, customs fees, and taxes imposed by their country of import. The Company does not reimburse for these charges.

5.3 Risk of Loss and Delivery
Title and risk of loss transfer to you when the item is handed to the shipping carrier (FedEx, UPS, DHL, local postal service, or equivalent). Once an order ships, the Company is no longer responsible for loss, theft, or damage in transit. The carrier assumes all liability. You should track your shipment using the tracking number provided; inspect packages immediately upon receipt for damage or tampering; file claims with the carrier if packages arrive damaged or do not arrive; photograph damage and retain original packaging as evidence; contact the Company within 48 hours of delivery if damage or discrepancies are discovered.

5.4 Undeliverable Addresses and Refused Packages
If a package is returned to the Company due to an undeliverable address, incorrect address, or customer refusal, the customer is responsible for all return shipping costs. The Company will attempt to contact you; if no response is received within 30 days, the item will be retained, donated, or discarded, and no refund will be issued. You are responsible for providing a valid, accurate delivery address at checkout. The Company assumes no liability for delivery to incorrect addresses or the consequences of such misdirection.

6. RETURNS AND REFUNDS

6.1 Return Eligibility and Timeframe
The Company offers returns within 30 days of delivery. To be eligible for a return: the product must be returned within 30 calendar days from the delivery date; the product must be in its original, unused, uncontaminated condition; original packaging, labels, seals, and documentation must be intact and undamaged; for beauty instruments and electronic devices: no signs of use, testing, or operation; return authorization must be obtained by contacting support@vitayouth.store prior to shipping; the returned item must include the original invoice or order number.

6.2 Non-Returnable Items
The following items are NON-RETURNABLE and NON-REFUNDABLE: products with opened, broken, or damaged seals; skincare serums, creams, masks, oils, or any cosmetic with visible use; supplements, capsules, powders, or ingestibles; beauty instruments, electronic devices, or laser pens showing evidence of use, charging, or activation; perishable or time-sensitive items; products returned more than 30 days after delivery; clearance, final sale, or outlet items marked non-returnable; items damaged or contaminated by the customer; products subject to recalls or safety alerts (refund only, no return required); custom or personalized items; defective products beyond a 30-day window.

6.3 Return Process
To initiate a return: contact support@vitayouth.store within 30 days of delivery with your order number; provide a brief reason for return; receive return authorization and shipping instructions; ship the item to the return address provided (customer pays return shipping unless return is due to Company error or defective product); include your order number and return reason in the package; use trackable shipping and retain proof of delivery.

6.4 Refund Processing
Once a return is received and inspected: items meeting return criteria will be refunded within 7-10 business days; refunds are issued to the original payment method; refunds include the product purchase price only; shipping costs and return shipping are non-refundable; your payment processor may take an additional 3-5 business days to post the credit; items not meeting return criteria will be returned to you at your expense, or donated/discarded at the Company's discretion; no refund will be issued for items not received, damaged in return transit, or inspected as previously used.

6.5 Defective or Damaged Products
If a product arrives damaged, defective, or not as described: contact support@vitayouth.store within 48 hours with photos of the damage and original packaging; provide your order number and a detailed description of the defect; the Company will review and determine whether replacement, credit, or full refund is appropriate; for defective beauty instruments or electronic devices, the Company reserves the right to request return before issuing a replacement or refund; if deemed defective by the Company, the customer will be issued a replacement or full refund; return shipping will be covered by the Company; claims of defect must be made within 30 days of delivery; claims made after 30 days will not be processed.

7. LIMITED WARRANTY

Subject to the exclusions in this section, the Company warrants to the original purchaser that products will be free from defects in materials and workmanship under normal, intended use for the following periods: Beauty instruments and electronic devices: 30 days from delivery; Skincare serums, creams, and topical products: No warranty; sold as-is; Supplements and ingestible products: No warranty; sold as-is.

WARRANTY EXCLUSIONS: This warranty does NOT cover: damage resulting from misuse, abuse, neglect, accident, or unauthorized repair; damage from drops, falls, crushing, liquid exposure, or submersion; normal wear and tear; use inconsistent with provided instructions or warnings; cosmetic or aesthetic damage that does not affect functionality; defects caused by power surge, electrical issues, or improper voltage; battery degradation or depletion over time; allergic reactions, skin sensitivities, or adverse health effects from product use; claims arising more than 30 days after delivery.

EXCLUSIVE REMEDY: If a product is found to be defective under this warranty within 30 days and return conditions are met, the Company's sole obligation and your exclusive remedy is repair or replacement at the Company's discretion, or refund of the purchase price only. The Company will not be liable for any other damages, losses, or costs.

DISCLAIMER OF OTHER WARRANTIES: EXCEPT AS EXPRESSLY STATED IN THIS SECTION, THE COMPANY MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PRODUCTS ARE PROVIDED AS-IS.

8. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITY, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR COSTS OF COVER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE SHALL BE LIMITED TO THE AMOUNT PAID FOR THE SPECIFIC PRODUCT OR SERVICE IN QUESTION, NOT TO EXCEED USD $500.00 IN AGGREGATE.

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, etc.) and shall apply to all claims, whether arising before or after the date of these Terms. Some jurisdictions do not permit limitations of liability. In such cases, this limitation shall apply to the maximum extent permitted by law.

The Company is not liable for: any health effects, adverse reactions, allergies, or injuries resulting from product use; outcomes or results not achieved from products; product compatibility with other treatments, medications, or skincare products; customization or modification of products by third parties; third-party content, links, recommendations, or endorsements on the website; website downtime, outages, errors, or security issues; unauthorized access to user accounts or payment information.

9. PROHIBITED ACTIVITIES

You agree not to engage in any of the following prohibited activities: fraudulent or deceptive purchasing; excessive or unusual order patterns designed to abuse refund or return policies; chargebacks, disputes, or reversal of legitimate transactions without contacting Company support first; purchasing products for the purpose of reselling, bulk distribution, commercial use, or dropshipping without explicit written authorization; hacking, unauthorized access, scraping, or attempting to circumvent security measures; posting defamatory, abusive, harassing, or illegal content; harvesting customer data without consent; circumventing geographic restrictions or sanctions compliance measures; using the website for illegal purposes; attempting to return items that have been contaminated, used, or altered; operating automated bots, scripts, or crawlers.

VIOLATION CONSEQUENCES: Any violation may result in immediate account suspension, cancellation of pending orders, forfeiture of refunds, referral to law enforcement or payment processors, and permanent ban from the website. The Company may pursue legal remedies and recover costs and damages through litigation or collection proceedings. If fraudulent activity is detected, the Company will cooperate fully with law enforcement and financial institutions in investigations and prosecution.

10. INTELLECTUAL PROPERTY RIGHTS

All content on VitaYouth.store, including text, graphics, logos, images, videos, product descriptions, reviews, layouts, and designs, are the exclusive property of the Company or licensed from third parties and are protected by international copyright, trademark, patent, and trade secret laws.

11. USER ACCOUNTS AND SECURITY

14. DISPUTE RESOLUTION AND ARBITRATION

Before initiating arbitration, you agree to attempt to resolve the dispute informally. If the Company and you cannot reach a resolution within 30 days, either party may proceed to arbitration.

14.2 Binding Arbitration
If the dispute is not resolved informally, BOTH PARTIES AGREE THAT THE DISPUTE SHALL BE FINALLY RESOLVED BY BINDING ARBITRATION administered by JAMS (Judicial Arbitration and Mediation Services) under its Streamlined Arbitration Rules and Procedures. This means: THERE WILL BE NO JURY TRIAL OR CLASS ACTION LAWSUIT; a neutral arbitrator will hear the dispute instead of a judge; discovery is limited, and the process is faster and less formal than court litigation; the arbitrator's decision is final and binding; you waive any right to pursue the claim in court or participate in class actions. Arbitration will be conducted remotely (by videoconference or telephone) unless agreed otherwise. Each party will bear its own attorney fees unless the arbitrator awards fees to the prevailing party as allowed by law.

14.3 Exceptions to Arbitration
Notwithstanding the above, the following disputes are NOT subject to arbitration and may be brought in court: claims for intellectual property infringement; claims arising from fraud, misrepresentation, or gross negligence; claims within small claims court jurisdiction (if you opt out of arbitration in writing within 30 days); emergency injunctive relief to prevent irreparable harm.

14.4 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict-of-law principles. The arbitration shall take place in Wyoming or as agreed by the parties. Any party wishing to proceed in court must do so in the state or federal courts located in Wyoming.

14.5 Class Action Waiver
YOU AGREE THAT ANY ARBITRATION OR COURT PROCEEDING WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION. YOU WAIVE THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION OR CLASS ARBITRATION AGAINST THE COMPANY. If a court determines this clause is unenforceable, any class action claim must be brought in court; arbitration will not apply.

15. GENERAL PROVISIONS

15.1 Entire Agreement
These Terms, together with the Privacy Policy, Return Policy, Shipping Policy, and any other policies posted on the website, constitute the entire agreement between you and the Company regarding the use of the website and purchase of products.
